Deceased Estates
When someone passes away, there needs to be a person in charge of sorting out the deceased’s Estate. Property, money and debts collectively are known as their Estate. It is a lengthy and not quite straightforward process, even if there is a Will.
When it comes to property ownership, the deceased person's name would need to be removed from the property Title in order to transfer or sell the property to a third party or the beneficiaries of the Estate.
A Deceased Estate settlement transaction is the process of transferring the property to the surviving co-tenant, the Administrator or the Executor if there is a Will.
If you are the Administrator or Executor of the Will, you will need to lodge an Application with Landgate to enable the deceased person's property to be sold or transferred. When this Application is approved, the ownership of the deceased’s property is moved to you as Executor so that you can then tidy up their affairs and distribute their assets according to their wishes.
